Status Hukum Perkawinan Adat Benteng Tado Dengan Menggunakan Belis

Abstract

This research is entitled Belis Marriage in the Benteng Tado Society of East Nusa Tenggara from the Perspective of the National Marriage Law. The background of this research is because there are many cases of divorce in marriage that are not reported to law enforcement officials, or have even been reported but rejected. Among them is rape in marriage. This happens because sexual relations carried out in marriage are considered as common things that husbands do to their wives, because they occur in legal marriages. This study aims to determine the legal consequences of marriage for parties who are married using belis (dowry). The research method uses normative juridical. This research approach uses legislation and conceptual. Based on research, family maintenance has not been clearly regulated in the Civil Code (KUHPer). However, it has been regulated in Law Number 16 of 2019 concerning Marriage. And legal consequences in marriage are obliged to obtain rights and obligations in the family by husband and wife based on Law Number 16 of 2019 concerning Marriage.
