Abstract

Materi pokok penelitian Perlindungan Hukum Investor/Member Perjanjian Investasi Online
(@nitip.invest), dengan permasalahan Bagaimana perlindungan hukum investor/member perjanjian
investasi online (@nitip.invest) dan Apakah investor/member investasi online (@nitip.invest) dapat
menuntut ganti rugi. Bentuk bisnis investasi yang sangat digemari oleh masyarakat Indonesia adalah bisnis
investasi yang menjanjikan keuntungan sebesar-besarnya dan juga memiliki modal dan resiko sedikit. Di
Kabupaten Tuban, salah satu bisnis investasi online yang sempat menjadi pusat perhatian yaitu
@nitip.invest yang telah merugikan uang investor/member bisnis investasi tersebut, sehingga investor
tersebut menanyakan perihal keuntungan yang dijanjikan pemilik bisnis tersebut pada kesepakatan diawal
perjanjian bisnis investasi online tersebut. Metode penelitian menggunakan pendekatan
perundang-undangan, pendekatan konsep, serta pendekatan kasus, dapat diambil kesimpulan melakukan
perbuatan melanggar hukum dapat dimintakan pertanggungjawaban ganti rugi atas dasar sudah
melakukan perbuatan melanggar hukum sebagaimana yang diatur dalam Pasal 1365 KUH Perdata. Perihal
ini jika perlindungan hukum terhadap investor/ member dengan menggugat ganti rugi berbentuk
penggantian biaya, rugi, serta bunga. Owner bisnis investasi dapat di gugat ke pengadilan apabila
melakukan wanprestasi, karna sesuai dengan apa yang telah diperjanjikan akan mentaati apa yang telah
diperjanjikan, walaupun hanya perjanjian lisan ataupun hanya chat Whatsapp/ Instagram tetapi bukti
tersebut bisa disertakan apabila akan menggugat kerugian ke pengadilan. Ganti rugi yang bisa dituntut oleh
member/ investor kepada owner bisnis investasi online yang melakukan wanprestasi dalam perihal ini
penggelapan uang serta tidak ada itikad baik untuk menuntaskan kewajibannya maka dalam ketentuan
Pasal 1239 KUH Perdata.

The subject matter of the research is Legal Protection of Investors/Members of Online Investment Agreements
(@nitip.invest), with the problem of How is the legal protection of investors/members of online investment agreements
(@nitip.invest) and whether investors/members of online investment (@nitip.invest) can sue compensation. The form of
investment business that is very popular with the people of Indonesia is an investment business that promises the
maximum profit and also has little capital and risk. In Tuban Regency, one of the online investment businesses that had
become the center of attention was @nitip.invest which had harmed the investors/members of the investment business,
so the investor asked about the profits promised by the business owner in the agreement at the beginning of the online
investment business agreement. Using a statutory approach, a conceptual approach, and a case approach, it can be
concluded that committing an unlawful act can be held liable for compensation on the basis of having committed an
unlawful act as regulated in Article 1365 of the Civil Code. In this case, if the legal protection for investors/members is
to sue for compensation in the form of reimbursement of costs, losses, and interest. Investment business owners can be
sued in court if they are in default, because in accordance with what has been agreed they will obey what has been
agreed, even if it is only an oral agreement or just a Whatsapp/Instagram chat, but the evidence can be included if you
are going to sue for losses to court. Compensation that can be claimed by members/investors to online investment
business owners who default in this case is embezzlement of money and there is no good faith to complete their
