Abstract

Marriage is a human right that belongs to every human being. In general, marriages are carried out by adults, but nowadays it is not uncommon for children who are not yet adults to get married due to various factors. What is meant by a child is someone who is still not legally capable and still requires guidance from parents. Children are future human resources whose rights have been regulated by the State in laws related to children's rights, for example the Convention on the Rights of the Child which was ratified by the United Nations on 20 November 1989. Indonesia has also agreed to the convention on 5 September 1990 through Presidential Decree No. 36 of 1990. The research method used is a normative research method, with a naturalistic approach and data combining or triagulation techniques. The Convention on the Rights of the Child does not clearly stipulate the protection of early marriage, but a child has the right to express freely about his views, freedom to think about a matter and express opinions, then the State will protect children from all forms of exploitation including sexual abuse.
