Abstract

This journal is intended to address the government's efforts to ensure that indigenous peoples have access to Covid-19 vaccination as a right to health during the pandemic period. Provision of Covid-19 vaccination to all citizens has evolved into a strategy for containing the Covid-19 pandemic. Indigenous peoples are one of the vulnerable groups in the Covid-19 pandemic, having previously been vulnerable due to limited access to health care. This article is a piece of normative legal research that employs a statutory framework. As a result, the government has prioritized vaccination for indigenous peoples in The Minister of Health Regulation No. 84 of 2020. Then, the government's provision of vaccination priorities was also in accordance with the principle of non-discrimination, with indigenous peoples included in the socio-demographic group eligible for vaccination priority. As a result of this, the government enacted Article 28H paragraph (1) of the 1945 Constitution, which states that every citizen has the right to health care.
