PEMENUHAN HAK KEMANUSIAAN TERHADAP TERSANGKA PENGIDAP DISABILITAS PADA PROSES PENYIDIKAN

Abstract

The protection of the rights persons with disabilitis has been regulated in law, but in its application there are still conflicts and widespread discrimination in terms of efforts to fulfill the rights of persons with disabilities. This conflict occurs due to several factors, namely from the applicable legal regulations and law enforcers. The enactment of Law Nomor 8 of 2016 concerning human with disabilitis has implemented major changes by rearranging the word disabled to become persons with disabilities so that the mindset of the community does not assume that people with disabilities have physical or mental deficiencies, and provides equality with others. In the realm of the judiciary, in the legal substance, namely the KUHAP regulations, there are currently no special regulations that treat persons with disabilities so that discriminatory actions often occur in the investigation process in Indonesia.
