Abstract

Right to  freedom of opinion is the right of every individual as a human being. This right is internationally protected by Universal Declaration of Human Rights and the International Covenant of Civil and Political Rights. Likewise, nationally, this right is protected by the 1945 Constitution and the Human Rights Act. Now Indonesia has entered a new era, namely the era of digital democracy, where this digital democracy is a new way or a strategy to implement the concept of democracy that is not confined within a time limit, so that this democratic practice can be done anywhere, anytime, and can be done in a fast time. . The entry of this digital era, there is many Indonesian people who are pro and a contra of the entry of the digital democracy era, because the Indonesian people themselves still do not have high literacy skills. The article used is included in the normative juridical method, Which is by conducting an assessment of the 1945 Constitution, the Human Rights Law, and the ITE Law.
