<p>Roasting, as a form of stand-up comedyart, often sparks debates regarding its legal and ethical boundaries, especially when the subject being roasted feels personally harmed or their reputation tarnished. This study aims to analyze whether roasting can be categorized as defamation under Indonesia's positive law. Using a qualitative approach, this research examines legal provisions in the Indonesian Penal Code (KUHP) and the Electronic Information and Transactions Law (UU ITE) concerning defamation. The findings reveal that roasting can be classified as defamation if it meets the subjective and objective elements outlined in Articles 310 and 311 of the Penal Code and Article 27 Paragraph (3) of the UU ITE. However, the context of art and humor may serve as a consideration in legal proceedings. This study underscores the importance of balancing freedom of expression with respect for human rights, particularly the right to honor and reputation. The findings aim to provide insights for artists and the public in understanding the legal implications of roasting actions. Keywords: roasting, defamation, positive law</p>

<p>Criminalization of journalists is a form of crime that is rarely noticed by the local community, this is the basis for writing this journal. So that the local community understands the existing rules for conveying news that concerns a person's good name or the good name of an agency. Journalism is a profession that exists in Indonesia and has laws that regulate journalists in seeking and publishing news. Journalists themselves have a Press Council which supervises and defends journalists who are involved in a problem, including the problem of criminalizing journalists. about the defamation that journalists often receive from people who are anti-criticism. Defamation of our good name, if we examine it and you need to know, is a form of verbal activity that concerns our good name, that of other people, or institutions that aims to undermine our dignity and dignity that is not based on existing facts and using language that contains sarcasm. However, what journalists have done in reporting on individuals or institutions, I think have gone through various procedures to find information and it is very complicated to get to the publication stage, so that it can be accepted and read by the general public.</p>
